Terms of Service

Effective date: April 24, 2026

These terms govern your use of SectionNotes Datum, operated by AyPex Holdings LLC. By creating an account or paying for a subscription, you agree to these terms.

1. The service

SectionNotes Datum (“the Service”) is an online study platform for the ARE 5.0 architecture licensing exam. It includes practice questions, reasoning engines, command cards, mock exams, case study simulators, and mastery tracking.

2. Accounts

You must provide accurate information when registering. You are responsible for maintaining the security of your password. One account per person. Sharing account credentials is prohibited and may result in termination without refund.

3. Subscriptions and payment

Plans:

  • Free: PcM division only
  • Pro: $29/month or $199/year
  • Pro+: $49/month or $399/year — includes physical Command Cards and Redline digital content

Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel anytime from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then.

Prices are in US dollars. Payment processed by Stripe.

4. Refund policy

  • 30 days, no questions asked: full refund within 30 days of any charge — first payment, renewal, monthly, or annual.
  • Pro+ physical Command Cards: once shipped, the physical product is non-refundable; digital access follows the 30-day rule above.
  • Outside 30 days: not automatic, but honest cases are reviewed. Email us promptly if a renewal hits unexpectedly.

5. Acceptable use

You agree not to:

  • Share your account or content from the Service with non-subscribers
  • Scrape, copy, or redistribute question banks, reasoning engine logic, or command card content
  • Reverse-engineer the Service
  • Use the Service to harass other users or send unsolicited communication
  • Upload illegal, infringing, or malicious content

Violation may result in account termination without refund.

6. Content ownership

Our content. All questions, reasoning engines, command cards, redline content, and app interfaces are the intellectual property of AyPex Holdings LLC. You receive a personal, non-transferable license to access them while your subscription is active.

Your content. Notes, answers, and progress data you create remain yours. We store and process them to deliver the Service. You grant us a license to do so for as long as your account is active.

7. No guarantee of exam results

SectionNotes Datum is a study tool. We do not guarantee that use of the Service will result in passing the ARE or any portion of it. Passing the ARE depends on your individual preparation, aptitude, and performance on exam day.

8. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, AyPex Holdings LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

You may cancel your account at any time. We may suspend or terminate your account for violation of these terms, non-payment, or legal requirement. On termination, your access ends and data is handled per our Privacy Policy.

11. Changes to these terms

We may update these terms. Material changes will be communicated by email or in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Sheridan County, Wyoming.
